Understanding Customs Bonds in the Philippines: Types, Requirements, and How to Get One

A customs bond is a financial instrument - typically a surety bond issued by an accredited insurance company - that guarantees a business will meet its customs obligations. In the Philippines, the Bureau of Customs requires various types of bonds as a condition of operating within the customs system. Failure to maintain required bonds can result in suspension of import privileges, seizure of goods, or loss of customs accreditation.

Why the BOC Requires Customs Bonds

Customs bonds exist to protect the government's revenue interest. When goods are admitted under a customs procedure that defers, suspends, or conditionally exempts duty payment - such as bonded warehousing, transit, or temporary admission - the bond guarantees that if the duty obligation is not ultimately satisfied, the surety company will pay the government on the importer's behalf.

Types of Customs Bonds in the Philippines

Import Bond

Required by certain importers as a condition of BOC accreditation, particularly for first-time importers or those in high-risk commodity categories. The bond guarantees the payment of customs duties and taxes on imported goods.

Customs Bonded Warehouse Bond

Required for the operation of a customs bonded warehouse. The bond guarantees that goods stored in the facility without duty payment will either be cleared through customs or re-exported - and that duties will be paid if neither condition is met within the authorized period.

Transit Bond

For goods moving through the Philippines in transit to another country without being imported for local consumption. The transit bond guarantees that the goods will either be exported as declared or have duties paid if they are diverted to local consumption.

Customs Broker Bond

Required for all licensed customs brokers practicing before the BOC. Guarantees the broker's compliance with all BOC regulations and their fiduciary responsibilities to clients.

How to Secure a Customs Bond

  • Identify the required bond type based on your import activity and BOC accreditation requirements.
  • Select a BOC-accredited surety company. Only insurance companies on the BOC's approved list can issue customs bonds. TMG works with accredited surety providers and can recommend appropriate partners.
  • Apply for the bond with supporting financial documents. The surety company will assess your financial capacity relative to the bond amount required.
  • Submit to the BOC as part of your accreditation application or renewal documentation.
  • Renew annually - most customs bonds must be renewed each year. TMG tracks renewal dates and initiates the renewal process in advance to prevent lapse.

Bond Amounts

The required bond amount is typically determined by the BOC based on factors including your estimated annual import value, commodity category, and duty exposure. TMG's customs team assists in determining the appropriate bond amount for your specific circumstances and represents your interests in discussions with the BOC on bond requirements.
